This website (jamescartersound.com and app.jamescartersound.com, together the "Site") and the creative tools available on it (the "Tools") are owned and operated by James Carter, an individual, trading personally ("we", "us"). By using the Site or Tools you agree to these terms.
For the avoidance of doubt: the Site, its Tools, brand and content are owned and operated by James Carter personally. Muso Play On Pty Ltd provides administrative services only and holds no ownership interest or claim in the Site, its Tools, brand or content.
The Tools (including Harmonic, CHORD DAW and Finish It) are provided free of charge, in your browser, for personal, non-commercial learning and music-making. We may add, change, suspend or retire features at any time without notice. Progress may be stored locally in your browser and, if you create an account, synced to our servers — we recommend you do not rely on the Tools as your only copy of anything important.
Anything you create with the Tools — progressions, arrangements, projects, exports — is yours. We claim no ownership of your musical work.
The Site, the Tools, their design, code, text, imagery and branding are our intellectual property (or that of our licensors) and may not be copied, resold or redistributed without written permission. Song titles and artwork shown in the play-along library remain the property of their respective owners and are referenced for educational purposes; audio is streamed from YouTube under YouTube's own terms.
If you enter your email you consent to receiving occasional emails from us about the Tools, upcoming courses (such as Artist Bound) and the community. You can unsubscribe at any time via the link in any email. Paid offerings, when they launch, will carry their own terms presented at purchase.
The Site relies on third-party services including YouTube (playback), Kit (email), Supabase (accounts and sync), Cloudflare (hosting) and Google Analytics (usage statistics). Their terms and privacy policies apply to their services.
The Site and Tools are provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that they will be uninterrupted, error-free or fit for any particular purpose. Nothing on the Site is professional advice.
To the maximum extent permitted by law (including the Australian Consumer Law, whose statutory guarantees are not excluded), we will not be liable for any indirect, incidental or consequential loss arising from your use of the Site or Tools. Where liability cannot be excluded, it is limited to re-supplying the relevant service.
We may update these terms from time to time. The "last updated" date above tells you the current version. Continued use after a change means you accept the updated terms.
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.
